Welcome to MediSave. These Terms of Service ("Terms") govern your use of the MediSave mobile application, website (medisaveapp.com), and related services (collectively, the "Service") operated by MediSave ("we," "our," or "us").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. About MediSave
MediSave is a healthcare technology platform that helps users compare medicine prices, find affordable alternatives, manage prescriptions, and connect with pharmacies and doctors. MediSave is an information and convenience platform — we are not a pharmacy, hospital, or medical provider.
2. Eligibility
- You must be at least 18 years old to create an account.
- You must provide accurate and complete registration information.
- You are responsible for maintaining the security of your account credentials.
- One person may not maintain more than one account.
3. The Service
a) For Patients / Consumers
- Search and compare medicine prices across pharmacies.
- Find affordable generic alternatives and Janaushadhi medicines.
- Manage a personal medicine cabinet with reminders.
- Receive digital prescriptions from doctors.
- Scan prescriptions and upload lab reports.
- Book doctor appointments and video consultations.
b) For Doctors
- Write and manage digital prescriptions.
- Manage patient records and follow-ups.
- Route prescriptions to partner pharmacies.
- Manage appointments, availability, and video consultations.
- Build a public professional profile.
c) For Pharmacy Partners
- Manage medicine inventory, stock levels, and pricing.
- Receive and fulfill prescriptions from doctors.
- Create bills and manage customer transactions.
- Build a public pharmacy profile with MediSave listing.
4. Medical Disclaimer
IMPORTANT: MediSave is NOT a substitute for professional medical advice, diagnosis, or treatment.
- Medicine price comparisons and alternative suggestions are for informational purposes only.
- Always consult your doctor before switching medicines or changing dosages.
- Generic alternatives shown may not be suitable for your specific condition.
- We do not verify the accuracy of medicine prices displayed by pharmacies.
- AI-powered features (chat, scan) provide general information and may contain errors.
- In case of a medical emergency, contact your doctor or call emergency services immediately.
5. User Responsibilities
You agree to:
- Provide accurate information when registering and using the Service.
- Not use the Service for any unlawful purpose.
- Not impersonate any person or entity.
- Not attempt to gain unauthorized access to any part of the Service.
- Not upload malicious content, spam, or harmful material.
- Not scrape, crawl, or extract data from the Service without permission.
- Keep your account credentials secure and notify us of unauthorized access.
For Doctors specifically:
- You must hold a valid medical license to write prescriptions on MediSave.
- You are solely responsible for the accuracy and appropriateness of prescriptions you create.
- MediSave does not verify prescription content — only that your license is registered.
For Pharmacy Partners specifically:
- You must hold a valid pharmacy license to operate on MediSave.
- You are responsible for the accuracy of your inventory, pricing, and stock information.
- You must comply with all applicable pharmacy regulations and drug laws.
6. Intellectual Property
- The MediSave name, logo, design, and content are our intellectual property.
- Medicine data (names, compositions, prices) is sourced from public databases including NPPA and Jan Aushadhi.
- You may not copy, modify, distribute, or create derivative works from the Service without permission.
- Content you create (prescriptions, community posts, reviews) remains yours, but you grant us a license to display it within the Service.
7. Pricing & Payments
- MediSave is currently free for all users during our launch period.
- Medicine prices shown are provided by pharmacies and public databases. We do not guarantee their accuracy or availability.
- Actual purchase prices may differ from displayed prices.
- If we introduce paid features in the future, we will notify you in advance and provide clear pricing.
8. Community Guidelines
When using community features (posts, reviews, comments), you agree to:
- Not post false, misleading, or harmful health information.
- Not harass, abuse, or threaten other users.
- Not post promotional or spam content.
- Not share personal medical information of others without consent.
We reserve the right to remove content and suspend accounts that violate these guidelines.
9. Prescription Services
- Digital prescriptions are created by licensed doctors and routed to pharmacies at the patient's or doctor's request.
- Prescription codes are valid for 30 days from the date of creation.
- MediSave acts as a platform to connect doctors, patients, and pharmacies — we do not dispense medicines.
- Pharmacies independently verify prescriptions before dispensing medicines.
10. Limitation of Liability
To the maximum extent permitted by law:
- MediSave is provided "as is" without warranties of any kind.
- We do not guarantee uninterrupted, error-free, or secure operation of the Service.
- We are not liable for any damages arising from your use of the Service, including but not limited to health outcomes from medicine information provided.
- We are not responsible for the actions, products, or services of pharmacies, doctors, or other users on the platform.
- Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim (which is currently zero, as the Service is free).
11. Indemnification
You agree to indemnify and hold MediSave harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
12. Account Termination
- You may delete your account at any time by contacting us.
- We may suspend or terminate your account if you violate these Terms.
- Upon termination, your right to use the Service ceases immediately.
- We may retain certain data as required by law or for legitimate business purposes.
13. Platform Nature & Role
MediSave is a technology platform that provides information services. We are NOT:
- A pharmacy or medicine retailer
- A hospital, clinic, or medical practice
- A diagnostic laboratory
- An insurance provider
We facilitate connections between patients, doctors, pharmacies, and labs. All medical services are provided by independently licensed professionals and establishments.
14. Schedule H & Prescription Medicines
- Certain medicines displayed on MediSave are classified as Schedule H or Schedule H1 under the Drugs and Cosmetics Act, 1940.
- These medicines require a valid prescription from a registered medical practitioner before purchase.
- MediSave displays these medicines for informational and price comparison purposes only.
- Pharmacies on our platform are independently responsible for verifying valid prescriptions before dispensing Schedule H/H1 medicines.
- Displaying a Schedule H medicine on MediSave does not constitute an offer to sell without prescription.
15. Telemedicine Services
- Video consultations on MediSave are conducted by independently registered medical practitioners in compliance with the Telemedicine Practice Guidelines 2020 issued by the Board of Governors (superseding the Medical Council of India).
- MediSave provides the technology platform for telemedicine; we do not practice medicine.
- Doctors using our telemedicine feature are solely responsible for clinical decisions, prescriptions, and adherence to telemedicine guidelines.
- Telemedicine consultations may not be appropriate for all medical conditions. In emergencies, visit the nearest hospital.
16. Limitation of Liability (Enhanced)
In addition to the existing limitation:
- MediSave shall not be liable for any adverse health outcomes resulting from medicine information, price comparisons, or alternative suggestions displayed on the platform.
- We are not responsible for the quality, efficacy, or safety of medicines dispensed by pharmacies.
- We are not liable for misdiagnosis, treatment decisions, or prescription errors by doctors using our platform.
- Lab report analysis by AI is for informational purposes only and may contain errors. We are not liable for decisions made based on AI-generated health insights.
- Our aggregate liability for all claims shall not exceed INR 5,000 or the amount paid by you in the preceding 12 months, whichever is lower.
17. Dispute Resolution
- Any dispute arising from these Terms shall first be attempted to be resolved through amicable negotiation within 30 days.
- If unresolved, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.
- The arbitration shall be conducted in English, with the seat in Visakhapatnam, Andhra Pradesh.
18. Governing Law
These Terms are governed by the laws of India. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Visakhapatnam, Andhra Pradesh, India.
19. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes through the app or website. The "Last updated" date at the top reflects the most recent revision. Continued use of the Service after changes constitutes acceptance.
